Buyers and Sellers to remember the new measures of lawyers holding conveyancing money from 01-Aug-2011.

 

The option fee is usually paid by the buyer directly to the seller and is unaffected by the measures.

*Not applicable for HDB resale flat transactions

 

 

Your lawyers will e-stamp the necessary documents on your behalf, and obtain a Payment Voucher. You can either:

a. Make payment directly to Commissioner of Stamp Duties with the Payment Voucher; or

b. Make payment indirectly, by depositing the money for stamp duties in either:

i. Your lawyer’s Conveyancing Account (“<Name of law firm>-CVY”); or

ii. Singapore Academy of Law.

 

 

Your lawyer can instruct the bank or Singapore Academy of Law to prepare the necessary cheques/cashier’s orders and submit the payment on your behalf. Indicate to your lawyer your preference to:

a. Place the money in your lawyer’s Conveyancing Account (“<Name of law firm>-CVY”);

b. Place the money with the Singapore Academy of Law; or

c. Make payment on your own directly to the seller or his nominees. Not applicable

 

 

*To exercise option, make payment by cheque/cashier’s order to either:

a. The seller’s lawyer’s Conveyancing Account (“<Name of law firm>-CVY”); or

b. Singapore Academy of Law

 

 

According to the seller’s preference.

*Indicate to your property salesperson or lawyer your preference to place the option deposit in your lawyer’s Conveyancing Account or with Singapore Academy of Law, and stipulate this in the option form.

Option Fee

Stamp Duties

Your lawyer may ask for a separate sum of up to $5,000 for each property, or $2,000 for en-bloc properties, to meet last-minute adjustments in payment amounts to different payees such as banks for mortgage payments. It is not mandatory for you to provide this sum. If you decide to provide it, this money can be paid to non-conveyancing bank accounts of the law firm, such as a normal client account.

Float

You should NOT leave out the “-CVY” suffix when issuing a cheque to the name of a law firm for conveyancing money.

 

You should NOT authorise anyone to receive your share of the sales proceeds on your behalf unless you trust that person with your money.

With effect from 1 August 2011:

a. Lawyers are not allowed to receive and hold conveyancing money in their normal client accounts. A breach of this prohibition will result in a fine of up to $50,000 and/or an imprisonment term of up to three months.


 

b. Lawyers are only allowed to receive and hold conveyancing money in a special Conveyancing Account opened with Appointed Banks designated by the Minister for Law. Most withdrawal or pay-out of money from Conveyancing Accounts requires two-party authorisation. Typically, the counter-signatory will be the lawyer representing the other party in the conveyancing transaction.


 

c. Buyers and sellers who wish to place conveyancing money in Conveyancing Accounts will have to indicate the payee’s name on their cheque/cashier’s order in the format “<Name of law firm>-CVY”. Lawyers holding on to CPF money on behalf of clients or on behalf of CPF Board are able to do so in separate Conveyancing (CPF) Accounts.


 

d. Buyers and sellers who do not wish to deposit money with their lawyers can instead instruct their lawyers to engage the Singapore Academy of Law (SAL) to hold conveyancing money, through SAL’s Conveyancing Money Service. Payment of such money via cheque/cashier’s order should be made to “Singapore Academy of Law”.


 

e. Alternatively, lawyers can receive and hold conveyancing money under escrow agreements between both buyers’ and sellers’ lawyers. These are more relevant for complex transactions.
